By downloading, installing, accessing, or using MyDiary ("MyDiary," the "App," "we," "our," or "us"), you agree to these Terms & Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.
MyDiary is a personal diary and journal application provided by Qunovix Technologies. It includes features such as diary entries, moods, tags, themes, templates, attachments, audio recording, reminders, app lock, recycle bin, export, backup, restore, advertisements, and optional Pro or ad-free features.
The App is provided for personal journaling, organization, reflection, and entertainment purposes only. It is not a substitute for professional medical, mental health, legal, financial, or other professional advice.
You are responsible for the entries, photos, videos, audio recordings, files, tags, and other content you create, import, save, export, back up, or share using the App.
Our collection and use of information is explained in our Privacy Policy. Please review it carefully.
The Android version of the App uses Firebase Core and Google Analytics for Firebase. These services may automatically process installation identifiers, device and app information, and usage events as described in the Privacy Policy. We do not intentionally send diary content or attachments to Firebase Analytics.
MyDiary is designed to store diary data primarily on your device. If your device is lost, damaged, reset, or uninstalled, your local diary data may be lost unless you have created a backup or export.
Google Drive backup and restore, exports, and imported files are provided as convenience features. We do not guarantee that every backup, restore, export, import, or file transfer will be successful or complete.
The App may offer local account, password, PIN, fingerprint, or biometric lock features. These features are intended to help protect casual access to the App on your device. They do not guarantee complete protection against every form of unauthorized access.
You are responsible for remembering your credentials, keeping your device secure, and managing biometric settings through your operating system.
Some features require device permissions, such as camera, microphone, photos/media, notifications, biometric access, internet access, or storage/file access. If you deny or disable permissions, related features may not work.
You agree not to use the App:
The App, including its software, design, graphics, themes, templates, icons, layouts, text, branding, and other materials, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms. You may not copy, sell, rent, modify, distribute, or commercially exploit the App or its content without our prior written permission.
You retain any rights you have in diary content that you create. These Terms do not give us ownership of your diary entries.
The App may use or interact with third-party services, including Firebase Core, Google Analytics for Firebase, Google Mobile Ads, Google Sign-In, Google Drive, Google Play Billing, app store services, device notification systems, file pickers, camera, microphone, media library, sharing tools, and external links opened through your browser.
Third-party services are governed by their own terms and policies. We are not responsible for third-party content, policies, purchases, advertisements, websites, backups, account access, outages, or services.
Analytics reports, measurements, and service availability may be delayed, incomplete, aggregated, or affected by device settings, connectivity, consent choices, platform restrictions, and third-party changes. We do not guarantee the accuracy or continued availability of Firebase or analytics services.
The App may display advertisements unless you are using an active ad-free or Pro entitlement where available. Ads are provided by third-party ad networks and may be subject to regional availability, ad network policies, and platform controls.
The App may offer paid features, Pro plans, subscriptions, or ad-free access. Purchases are processed by the applicable app store, such as Google Play, and are subject to that store's payment, renewal, cancellation, refund, and family-sharing rules.
Some paid features may change over time. We may add, remove, modify, suspend, or replace features where reasonably necessary, subject to applicable law and app store rules.
Diary reminders are optional and depend on your device settings, operating system restrictions, battery optimization, notification permission, and time-zone behavior. We do not guarantee that reminders will always arrive at the exact intended time.
The App may help you write, reflect, organize memories, track moods, or keep private notes. It does not provide medical, mental health, legal, financial, or emergency advice. If you need professional help, contact a qualified professional or local emergency services.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.
We do not guarantee that the App will always be available, secure, uninterrupted, free from bugs, compatible with every device, or that diary data, exports, backups, purchases, notifications, or ads will always work without issue.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, DIARY CONTENT, BACKUPS, PROFITS, GOODWILL, DEVICE FUNCTIONALITY, ACCOUNT ACCESS, OR OPPORTUNITY ARISING FROM OR RELATED TO YOUR USE OF THE APP.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the fullest extent permitted by law.
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, losses, and expenses arising from your misuse of the App, your violation of these Terms, your content, or your sharing, export, backup, or publication of diary content.
We may update, modify, suspend, or discontinue any part of the App at any time. We may also restrict or terminate access if we believe use of the App violates these Terms, applicable law, user safety expectations, app store rules, advertising network policies, or third-party platform policies.
The App may be available in multiple countries. You are responsible for complying with local laws that apply to your use of the App, including laws related to privacy, content, exports, recordings, backups, advertising, purchases, and device permissions.
These Terms are governed by the laws of India, without regard to conflict of law principles. Subject to any mandatory consumer protection rights available in your country of residence, disputes relating to these Terms or the App shall be subject to the courts located in Pune, Maharashtra, India.
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes are posted means you accept the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
